How is hiring-out of foreign workers regulated in Croatia?

Hiring-out of foreign workers is regulated by the Law on Foreigners in Croatia. The Ministry of Labour, Pension System, Family and Social Policy is charged with licencing and supervision of employment agencies as a regulated business, while the Croatian State Inspectorate supervises employers and employees in the Croatian labour market.

How do I get a foreign employee from the employment agency?

A client enters into a Employee Hiring-Out Agreement with a registered employment agency (BOSAK EMPLOYMENT) where all key elements of the mutual commercial relationship are defined, such as jobs, number of hired-out employees per each job, monthly fees per hire-out employee, duration of the agreement, status of the hired-out workers (regular or irregular-redistribution schedule), etc. Hired-out employees are employed with the employment agency (BOSAK EMPLOYMENT) as their formal employer, while they work at client’s premisses and according to client’s instructions. At the end of the month, calculation of work time is made according to the Agreement and the employment agency (BOSAK EMPLOYMENT) invoices work delivered by the hired-out employees to the client. The hired-out employees receive their salaries from the employment agency. The hired-out employees are not employees of the client, with the exception of legal provisions regarding health and safety at work where the client is treated as their „employer”.

How long does it take to get a hired-out foreign worker?

It depends whether the employee to be hired-out is already in Croatia possessing residence and work permit or not. If yes, it depends on the availability of the worker to be hired out. If not, then a usual time needed for the employment agency to provide an hired-out employee to a client is 30-60 days depending on location of origin of the employee. We always suggest our clients to initiate the communication on their needs towards the employment agency as early as possible to ensure enough time for the process. A swift „of-the-shelf” solution is not to be counted on.

Who is the formal employer of the hired-out employee?

Hired-out employees are always employed with the employment agency (BOSAK EMPLOYMENT) as their formal employer, while they work at client’s premisses and according to client’s instructions. The hired-out employees receive their salaries from the employment agency. The hired-out employees are never employees of the client, with the exception of legal provisions regarding health and safety at work where the client is treated as their „employer”.

If I have a seasonal business, is it possible to get a hired-out employee for a season only?

Yes, but as an employment agency (BOSAK EMPLOYMENT) has a year round cost of hired-out employee’s salary, this is subject to agreed mutual commercial relationship.

What service is provided by an employment agency regarding hired-out employees??

BOSAK EMPLOYMENT, as a licenced employment agency, provides the following services (after receiving information on client’s needs in that regard):

  • Search for potential employees to be hired-out (both internal and external)
  • Contacting potential candidates
  • Feedback to the client on potential employees to be hired-out availability and estimated start of work timeline
  • Interviewing potential candidates regarding specific client’s needs and requests
  • Selection of candidates
  • Acquiring selected candidate(s) to be hired-out to the client by negotiating and signing of employment agreement(s) between the employment agency (BOSAK EMPLOYMENT) and the client
  • Where needed, assistance to candidates in completing all required documentation for, both, visa and residence and work permit application
  • Completing the process of obtaining the residence and work permit
  • Where needed, completing the process of obtaining the visa to enter Croatia
  • Organisation of travel arrangements and accommodation in Croatia for the employee
  • Pick-up upon arrival and resolving other administrative issues (local police, opening of bank account, health certificate, health care and pension registration)
  • Initial transport of employees to the client and introduction
  • Regular communication with hired-out employees
What is a „hired-out employee”?

In other words, hired-out employees are „rented” or „leased” employees, and as such they are never employees of the client. They are always employed with an employment agency (BOSAK EMPLOYMENT) as their formal employer, while they only work at client’s premisses and according to client’s instructions. The client pays to the employment agency (BOSAK EMPLOYMENT) a monthly fee for the work provided by the „leased” employees. Hired-out employees always receive their salaries from the employment agency. The only exception provided by the legal provisions where the client is treated as formal employer of the hired-out employee is regarding health and safety at work measures.
